Welcome to The Power Project FZE. These Terms and Conditions govern your access to and use of our website www.projectHERd.com and the online coaching, training, and tutoring services provided through it.

By accessing the Site, registering for an account, or using the Services, you confirm that you have read, understood, and agreed to be bound by these Terms. If you do not agree, please do not use the Site or Services.

1. Company Information

The Power Project FZE is a company registered in the International Free Trade Zone (STRIP), Sharjah, United Arab Emirates (UAE). Our registered address is Block B - B14-085, SRTIP Freezone, Sharjah, United Arab Emirates. We provide coaching, professional training, and academic tutoring services for clients based in the UAE or offshore.

2. Eligibility

  •  You must be at least 18 years old (or the age of majority in your jurisdiction) to use our Services, unless you have documented parental/guardian consent.
  •  By using the Services, you represent that you meet this requirement and have the legal capacity to enter into these Terms.

3. User Accounts

When creating an account, you agree to:

  •  Provide truthful, accurate, and complete information.
  •  Maintain the confidentiality of your login credentials.
  •  Accept full responsibility for all activity under your account.
  •  Notify us immediately of any unauthorized use.

We reserve the right to suspend or terminate accounts that violate these Terms.

4. Description of Services

Our Services may include:

  •  Coaching sessions (group or individual)
  •  Professional training workshops
  •  Skill-building programs
  •  Academic tutoring sessions
  •  Access to digital training materials

Important Disclaimer: 

  •  Coaching and training are educational in nature and are not medical, psychological, or therapeutic services.
  •  We do not guarantee specific outcomes, certifications, or career results. Success depends on individual effort, participation, and external factors outside our control.

5. Fees, Payments & Refunds

  • All fees are quoted in UAE Dirhams (AED), United States Dollars (USD), or Great British Pounds (GBP)
  •  Payments must be made via bank transfer, credit/debit card, or approved online payment gateways.
  •  Non-refundable: Unless stated otherwise, all payments are non-refundable except where required by UAE law.
  •  Refunds (if applicable): A full refund may be requested within 7 days of purchase if no sessions have commenced. Cancellations with less than 24 hours’ notice are not eligible for refunds.
  •  Late payments may accrue interest at 1.5% per month.
  •  Clients are responsible for any applicable taxes or bank charges.

6. Intellectual Property Rights

  •  All content provided (including training materials, slides, workbooks, videos, exercises, and recordings) is the exclusive intellectual property of The Power Project FZE or our licensors.
  •  You are granted a limited, non-transferable license for personal use only.
  •  You may not copy, share, resell, or distribute any materials without prior written consent.
  •  Recording of sessions (audio or video) without our written approval is strictly prohibited.

7. Code of Conduct for Coaching & Training

During sessions, you agree to:

  •  Participate respectfully and avoid disruptive behavior.
  •  Refrain from harassment, offensive language, or discriminatory conduct.
  •  Not share login credentials or allow unauthorized persons to join paid sessions.

We reserve the right to remove or ban clients who violate these standards without refund.

8. Limitation of Liability

To the fullest extent permitted by law:

  •  We shall not be liable for indirect, incidental, or consequential damages, including lost opportunities, income, or reputational damage.
  •  Coaching/training advice does not replace professional advice in legal, medical, psychological, or financial matters.
  •  Our total liability for any claim shall not exceed the fees paid by you for Services in the past 12 months.

9. Disclaimer of Warranties

  •  Services are provided “as is” and “as available.”
  •  We do not guarantee uninterrupted access, error-free content, or specific training outcomes.
  •  Testimonials and success stories reflect individual experiences and do not guarantee results for all participants.

10. Indemnification

You agree to indemnify, defend, and hold harmless The Power Project FZE, its employees, and affiliates against all claims, damages, or expenses resulting from:

  •  Your breach of these Terms
  •  Misuse of the Services or materials
  •  Any unlawful activity connected with your use of the Site

11. Termination

  •  We may suspend or terminate your access at any time, without notice, if you violate these Terms.
  •  Upon termination, you lose all rights to access Services or content.
  •  Sections 6 (IP), 7 (Conduct), 8 (Liability), 9 (Disclaimer), and 10 (Indemnity) survive termination.

12. Governing Law & Dispute Resolution

  •  These Terms are governed by the laws of the United Arab Emirates.
  •  Any disputes shall be resolved exclusively in the courts of Sharjah, UAE.

13. Force Majeure

We are not liable for any failure or delay in Services caused by circumstances beyond our reasonable control, including internet outages, government restrictions, natural disasters, or pandemics.

14. Severability

If any provision of these Terms is found invalid or unenforceable, the remaining provisions remain fully in effect.

15. Entire Agreement

These Terms, along with our Privacy Policy and Payment, Refund & Cancellation Policy, constitute the entire agreement between you and The Power Project FZE.
